Design Registration

Design refers to the features of shape, pattern, configuration, ornamentation or composition of lines or colours applied to any article, in two or three dimensional forms. The design registration confers upon the registered proprietor the exclusive right to apply a design to the article in the class in which the design has been registered. If his right is infringed by any person, he can sue for infringement. He can license his design as legal property for a consideration. Registration primarily confers this right for ten years from the date of registration. If the fee for extension is not paid for the additional period of registration within the period of initial registration, this right will cease. There is provision for the restoration is filed within one year from the date of termination in the prescribed manner. For registering your design, firstly you have to file a design application. Information is required for design registration, which is given below:-

1. Name address of the applicant
2. Name of the articles to which the design is to be applied
3. Drawings
4. Details of first application in UK or convention country or group of countries or inter-governmental organization;
   • Name of the country
   • Official date
   • Official number
5. Power of Attorney

A legal right has given to the registered proprietor of the design to bring an action those persons who infringe the design, when his design is registered. The registered proprietor of the design can also claim to which he is legally entitled to.

International Design Registration

By International Design Registration, a design can be deposited simultaneously in many countries. An International Design Registration provides you the same protection as National Design Registrations in the countries concerned. A design application cannot be refused on account of the existence of older, probably conflicting design registrations. International Design registration gives ownership control on the design of the product and also gives the creator the right to take legal action against infringement, deterring others from potential infringement.
