Patent law infringement means breach of law or violation of right. It is an act of interference with one's exclusive rights to use the patent. It is mainly regarded as unlawful making or selling of patented invention. The various act such as disposing of, offering to dispose of, using, importing, keeping for disposal the patented article constitutes infringement of patent. In order to prove infringement following factors must be taken into consideration, a) to what extent monopoly rights have been conferred upon the patentee concerning complete specification b) whether the alleged acts amount to making, using, exercising, selling or distributing a product or using or exercising a method or process in the case of a process patent and c) whether the act really amounts to infringement.
